Terms of Service

These Terms of Service ("Terms") form a binding agreement between you ("you" or "user") and Facely ("Facely," "we," "us," or "our") governing your access to and use of the Facely website, AI-powered facial analysis tool, and related services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

Facely allows you to upload a photograph of your face and receive an AI-generated facial aesthetics report, which may include a numeric score, symmetry and proportion analysis, and personalized recommendations ("Analysis" or "Report"). The Service is provided for informational and entertainment purposes only.

The Service is not a medical, dermatological, psychological, or other professional service, and no Analysis constitutes medical advice, diagnosis, or treatment. See Section 6 for further limitations.

You must be at least 18 years old, or the age of legal majority in your jurisdiction, and have the legal capacity to enter into a binding contract to use the Service. By using the Service, you represent and warrant that you meet these requirements and that the photograph you upload depicts you, or that you have the explicit consent of the person depicted to upload their photograph for analysis.

The Service does not require you to create a persistent account. Each analysis session is initiated by uploading a photo directly through the Service. You are solely responsible for the photograph you upload and for ensuring you have the right to upload and process it under these Terms and applicable law.

Do not upload photographs of minors, photographs you do not have rights to, or photographs of any person without that person's knowledge and consent.

You agree not to use the Service to:

• Upload images depicting anyone other than yourself without their explicit consent;
• Upload unlawful, obscene, defamatory, or infringing content;
• Attempt to reverse engineer, scrape, decompile, or extract the underlying models or source code of the Service;
• Interfere with, disrupt, or overload the Service's infrastructure;
• Use the Service to harass, demean, or make consequential decisions about any third party; or
• Violate any applicable local, state, national, or international law or regulation.

We reserve the right to suspend or terminate access for any use that violates this Section.

The Analysis is generated automatically by artificial intelligence models based on the photograph you provide. AI-generated output is inherently probabilistic and may be inaccurate, incomplete, biased, or inconsistent between sessions, even for the same photograph.

The Analysis is not a medical, psychological, or professional opinion of any kind, is not a substitute for advice from a qualified physician, dermatologist, surgeon, or mental health professional, and should not be used as the basis for any medical, cosmetic, or personal decision. You should not rely on the Analysis as objective or scientific fact. Facely disclaims all warranties regarding the accuracy, reliability, or completeness of any Analysis.

Terms such as "PSL," "looksmaxxing," "softmaxxing," or similar labels used in the Service refer to informal online aesthetic-culture terminology and are presented as such — they are not scientific, clinical, or medical classifications, and do not measure a person's worth.

The full Analysis is offered as a one-time purchase of $14.90 USD. This is a single, one-time payment — the Service does not use subscriptions or recurring billing. Payments are processed by Stripe, our payment processor. Facely — not Stripe — is the seller and merchant of record for your purchase.

The price shown at checkout is a fixed amount in USD; no currency conversion is applied. Facely does not receive or store your full payment card details.

Refund eligibility for the one-time Analysis purchase is governed by our Refund Policy, which is incorporated into these Terms by reference.

The Service, including its design, text, graphics, software, and underlying technology, is owned by Facely or its licensors and is protected by intellectual property laws. Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access the Service for your personal, non-commercial use.

You retain any rights you already hold in the photograph you upload. Subject to those rights, you own the Analysis generated for you and may use it for personal, non-commercial purposes. "Facely" and associated logos are trademarks of Facely; you may not use them without our prior written consent.

The Service relies on third-party providers to operate, including payment processing (Stripe), AI model inference, and hosting/analytics infrastructure. Your use of the Service is also subject to the applicable terms of these providers where they interact with your data. See our Privacy Policy for details.

THE SERVICE AND ANY ANALYSIS ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TRYFACELY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, GOODWILL, OR EMOTIONAL DISTRESS, ARISING FROM YOUR USE OF THE SERVICE. TO THE EXTENT LIABILITY CANNOT BE EXCLUDED, TRYFACELY'S TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO TRYFACELY IN THE 12 MONTHS PRECEDING THE CLAIM. NOTHING IN THESE TERMS LIMITS ANY LIABILITY THAT CANNOT BE LIMITED OR EXCLUDED UNDER APPLICABLE LAW.

You agree to indemnify and hold Facely harmless from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your breach of these Terms, your violation of any law, or your uploading of content you did not have the right to upload.

We may suspend or terminate your access to the Service at any time, with or without notice, for conduct that we believe violates these Terms or is otherwise harmful to other users, us, or third parties. You may stop using the Service at any time. Sections of these Terms that by their nature should survive termination (including Sections 6, 9, 11, and 12) will survive.

We may update these Terms from time to time. Material changes will be reflected by updating the "Last updated" date above. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

These Terms are governed by French law, without regard to conflict-of-law principles, except where applicable consumer protection law requires the laws of your country of habitual residence to apply. If you are a consumer, this choice of law does not deprive you of the protection afforded by any mandatory provisions of the law of your country of residence.

Any dispute will be submitted to the competent French courts, without prejudice to your right as a consumer, where applicable law so provides, to bring proceedings before the courts of your own country of residence instead.
